This Acceptable Use Policy (“AUP”) sets the rules for using Faxday. It is part of our Terms of Service. Violations may result in suspension or termination.
Lawful fax only
You may use Faxday only for lawful communications for which you have the necessary rights and consent. You must comply with the Telephone Consumer Protection Act (TCPA), the Junk Fax Prevention Act, and all other applicable federal, state, and international laws.
No unsolicited advertising faxes
Sending unsolicited advertisements by fax is prohibited unless you have an established business relationship and provide a compliant opt-out notice, or you have prior express permission from the recipient. You are solely responsible for maintaining proof of consent and honoring opt-out requests.
Prohibited content and conduct
You may not use the service to transmit or store content that is illegal, fraudulent, harassing, defamatory, or infringing; to distribute malware; to attempt to gain unauthorized access to systems or data; to impersonate others or falsify sender identity; or to interfere with or overload the service or the networks it relies on.
Volume and fair use
High-volume or automated sending must stay within your plan and any rate limits we apply to protect service quality. We may throttle or review unusual sending patterns and require verification for large campaigns.
Security
Do not probe, scan, or test the vulnerability of the service, breach security or authentication measures, or access data that is not yours. Report vulnerabilities responsibly to [email protected].
Protected and sensitive data
Do not transmit protected health information without an executed Business Associate Agreement. You are responsible for ensuring that any sensitive data you send complies with the laws that apply to it.
Enforcement and reporting
We may investigate suspected violations and cooperate with law enforcement. We may remove content or suspend accounts that violate this AUP, with or without notice where necessary to protect the service or third parties. Report abuse to [email protected].
