These Terms of Service (“Terms”) govern your access to and use of Faxday, an online fax and workflow platform provided by RWR Technology (“Faxday,” “we,” “us”). By creating an account or using the service, you agree to these Terms on behalf of yourself and the organization you represent.
1. The service
Faxday lets you send and receive faxes over the internet, organize them into workflows, extract structured data, and connect via API. We provide the software and transport; you are responsible for the content you transmit and how you use it.
2. Accounts and eligibility
You must be at least 18 and provide accurate registration information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use. Organization administrators are responsible for the users they invite.
3. Acceptable use
Your use must comply with our Acceptable Use Policy and all applicable laws, including the Telephone Consumer Protection Act (TCPA) and Junk Fax Prevention Act. You must have the legal right and any required consent to fax the recipients you contact. Sending unsolicited advertising faxes is prohibited.
4. Fees, billing, and renewal
Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor. Subscriptions renew automatically until cancelled. Usage beyond your plan’s included pages or numbers may incur add-on charges. Fees are exclusive of taxes. Except where required by law or stated in our Refund & Cancellation Policy, payments are non-refundable.
5. Protected health information (HIPAA)
Faxday can support workflows that involve protected health information (“PHI”). If you are a covered entity or business associate and will transmit PHI, you must first execute a Business Associate Agreement (“BAA”) with us. Do not transmit PHI until a BAA is in place. 6. Your data and content
You retain all rights to the documents, data, and content you transmit or store (“Customer Data”). You grant us a limited license to host, process, and transmit Customer Data solely to provide and improve the service. We do not sell Customer Data. Our handling of personal data is described in our Privacy Policy.
7. Third-party services
The service relies on third-party providers for fax transport, payments, authentication, storage, email, and AI features. Your use may be subject to those providers’ terms. We are not responsible for third-party services outside our control.
8. Disclaimers
The service is provided “as is” and “as available.” Fax delivery depends on telephone networks and recipient equipment we do not control; we do not guarantee that every transmission will succeed or arrive by a specific time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, RWR Technology will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our aggregate liability arising out of or relating to the service will not exceed the amounts you paid us in the twelve months before the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold RWR Technology harmless from claims arising out of your Customer Data, your use of the service, or your violation of these Terms or applicable law.
11. Suspension and termination
We may suspend or terminate access for violation of these Terms, non-payment, or activity that risks harm to the service or others. You may cancel at any time as described in our Refund & Cancellation Policy. Upon termination, your right to use the service ends; we will make Customer Data available for export for a reasonable period unless prohibited by law.
12. Changes
We may update these Terms from time to time. Material changes will be posted here with a new effective date and, where appropriate, notified to account administrators. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. The exclusive venue for disputes is the state or federal courts located in Texas, unless applicable law requires otherwise.
